Following definitions apply in this agreement unless the context requires otherwise:
The Company means Melbourne Maxis.
Hirer shall deemed to be the person who has agreed or signed or the person responsible for the payment of the hire.
Hire shall be the period for which the vehicle has been hired or has been reserved for.
Employee means any employee of the company, including a driver or chauffeur employed by the company or agency contracted by the company.
Booking means a period for which the hirer has committed to the hire.
Deposit shall be amount paid under the terms of this agreement to secure a reservation.
Balance means the amount due under the terms of this agreement, less the deposit paid.
a) Company is not liable in the event of mechanical breakdown while on hire or in the event of accident, mechanical failure or when the vehicle becomes unsafe to drive. Then the company shall endeavour to make alternative arrangements to get the hirers to their destination. It will be the company's discretion to determine the method of onward travel. No claim can be made against the company, if the hirer decided to make alternative arrangement at their cost. No specific guaranties can be made in terms of time, reliability of the vehicle and events out of the direct control of the driver or the company. Company does not have to provide a specific vehicle requested by the hirer, if that vehicle is unavailable on the day due to unexpected circumstances.
b) Deposits are non refundable.
c) Extra charges will apply 15 minutes after the scheduled booking time at current hourly rate. (Hourly rates may change; enquiry should be made prior to bookings)
d) The hirer assumes full financial responsibility for any damage caused to any of the vehicles hired.
e) Company holds the right to cancel, delay or fully terminate a scheduled tour trip and will not have to compensate the hirer, however company will notify the hirer of the cancellation well before the scheduled time.
f) Company is not responsible for any articles left in the hired vehicle.
g) Smoking and food consumption is not permitted in vehicles.
h) Company holds the right to charge minimum fee of $50.00 or 10% whichever is greater cancellation fee from the hirer. If the hirer fails to meet the driver or cancel without adequate notice.
i) Baby Seat; upon request baby seats are provided (subject to availability) and it's the hirers total responsibility to ensure that the seat is correctly fitted before placing an infant into the seat. If the hirer does not consider that the seat provides sufficient protection or that is not fitted correctly, the hirer shall not allow the infant to travel.
